Resumen: De acuerdo a su finalidad constitucional, las FFAA apoyan la labor de la PNP en el restablecimiento del orden interno; en la situación actual de tensión que vive en el país para enfrentar la pandemia del COVID-19 es una de las acciones a la que el Estado ha recurrido, la misma que se amplia y prolonga en el tiempo sin un horizonte claro a la fecha y que podría abrir paso a otras formas de empleo de las FFAA que son materia de discusión. El presente artículo hace un análisis jurídico sumario de las normatividad supranacional y nacional en relación con el empleo de las FFAA y llamar la atención de las consecuencias legales y sociales que puedan tener a futuro. Con la experiencia aún en curso de las investigaciones y procesos juicios en contra de personal militar acaecido en el escenario del conflicto armado que vivió el país contra grupos armados delincuenciales y criminales de SL y MRTA, especialmente entre 1980 y el 2000, resulta de suma importancia analizar las implicancias legales a futuro del actual y continuo apoyo de las FFAA a la Policía Nacional.
Abstract: In accordance with its constitutional purpose, the Armed Forces support the work of the PNP in restoring internal order; in the current situation of tension that the country is experiencing to face the COVID-19 pandemic is one of the actions that the State has resorted to, the same that is extended and prolonged over time without a clear horizon to date and that could open the way to other forms of employment of the Armed Forces that are the subject of discussion. This article makes a summary legal analysis of the supranational and national regulations in relation to the use of the Armed Forces and draws attention to the legal and social consequences that they may have in the future. With the ongoing experience of the investigations and lawsuits against military personnel that occurred in the context of the armed conflict that the country experienced against armed delinquent and criminal SL and MRTA groups, especially between 1980 and 2000, it is extremely important analyze the future legal implications of the current and continued support of the Armed Forces to the National Police.
