La presente investigación tuvo como objetivo estudiar la legislación emitida por el Ministerio de salud de Perú en el marco de la emisión de normas de prevención ante la pandemia del COVID 19. La metodología que se utilizó es la cualitativa del tipo Investigación acción teniendo como finalidad la de determinar cómo el sector salud solucionó un vacío legal en la legislación laboral vigente, referida al rol del responsable del servicio de Seguridad y Salud en el trabajo en el trabajo (Ley N° 29783 y normativas complementarias), determinando su existencia, responsabilidad y funciones. Como conclusión señalar la falta de presencia del Estado en su rol de fiscalizador y la contratación de la legislación peruana con la de países vecinos en el área de seguridad industrial.
