Resumen: El acuerdo de Escazú es un tratado de Derechos Humanos, referidos a la gestión del medio ambiente y territorio en los países que han firmado y que tienen que ratificar el tratado. En el Perú, constitucionalmente, al afectar el territorio, automáticamente se afecta la capacidad de toma de decisiones del Estado y los derechos de la Nación.
Concebido como una iniciativa legal de la Organización de las Naciones Unidas (ONU), fundación que tiene el objetivo de promover la paz mundial, corresponde a la agenda global 2030. Tiene una visión y enfoque económico, elaborado en la Comisión Económica para América Latina (CEPAL), como una copia fiel y mejorada (a conveniencia), de la Convención de Aarhus. Su carácter es de Tratado Internacional, comparable al de un tratado de fronteras.
Abstract: The Escazú agreement is a Human Rights treaty, referring to the management of the environment and territory in the countries that have signed and have yet to ratify the treaty. In Peru, constitutionally, by affecting the territory, the decision-making capacity of the State and the rights of the Nation are automatically affected.
Conceived as a legal initiative of the United Nations Organization (UN), a foundation that has the objective of promoting world peace, it corresponds to the 2030 global agenda. It has an economic vision and approach, elaborated in the Economic Commission for Latin America ( ECLAC), as a faithful and improved copy (for convenience), of the Aarhus Convention. Its character is that of an International Treaty, comparable to that of a border treaty.
